Good practices for ALL races to follow (especially if you are innocent): 10 Considerstions if Stopped by the Police 1. Be polite and respectful when stopped by the police. Keep your mouth closed. 2. If you feel that your rights have been violated, you have the right to file a formal complaint with your local police jurisdiction after the fact. 3. Don’t, under any circumstance, get into an argument with the police. What do you think you are going to accomplish? 4. Always remember that anything you say or do can be used against you in court. 5. Keep your hands in plain sight and make sure the police can see your hands at all times. 6. Avoid physical contact with the police. No sudden movements, and keep hands out of your pockets. 7. Do not run because you are afraid of the police. 8. Even if you believe that you are innocent, do not resist arrest. 9. Don’t make any statements about the incident until you are able to meet with a lawyer or public defender. 10. Stay calm and remain in control. Watch your words, body language and emotions. Police officers way more often than not are good people trying to protect and serve. They are trained to deal with all types of people. They don’t know which one you are. Make their job easier and your experience better by following the guidelines above.2 points -

That's my point as well. My beliefs line up further to the "the knee itself didn't kill him" side of the argument than yours, though. I'm well aware that every detainee complains that his/her cuffs are too tight. "I can't breathe" is said during many, many arrests that work out just fine. I'm pretty claustrophobic. I get panicky if I put on a hoodie that's too small. I don't ride in the backseat of two-door cars or extended cab trucks because I'm scared that I can't get out if something bad happens. IF I somehow find myself in custody, I'm fairly certain that my heart rate will run away and my ability to breathe will be greatly decreased, knee on my neck or not. The problem is that if I'm not resisting and start foaming at the mouth and turning blue, I pray to God that the arresting officer has a little human decency and doesn't just hold me down and make wisecracks until my freaking life is gone.1 point -

But was he “fleeing” from a crime (other than simple trespass) or was he just leaving the house he was snooping around in? It’s all how you pose it. Nobody said all the other people in the many videos were fleeing. Also, did you just commit a Freudian slip? You just called it an “eventual murder” and not a death due to self defense. It is much deeper than FBI statistics. Before it is all done your thoughts will be judged. Your words will be judged. The hairs on your head will be numbered. This will be done on an individual basis. Nobody is really getting away with anything. They just think they are.1 point

My understanding is that the father told the police in a statement that they were trying to make a citizen’s arrest. I’m curious if that was their intent that day or just a defense he came up with after the fact. Regardless, I don’t believe that they were able to relay their intentions to Mr Arbery before the struggle over the gun commenced. On the same note, he has a lot more experience with the nuances of a citizens arrest after operating with his peace officer’s certification being expired for years, lol.1 point -

Was an arrest ever made bay the McMichaels? According to the police report I have read many times now, McMichaels claims they told Arbery, “Stop stop, we want to talk to you.” A conversation is not an arrest, and an unarmed citizen is under no legal obligation to stop and “talk” to other armed citizens who are blocking his path. Furthermore, by trying to stop him for questioning Instead of arresting Arbery is an illegal detainment. Arbery was under no obligation to stop and talk to 2 armed men in the street trying to detain him for questioning. In fact, stating an intention to question a Arbery might be used as evidence that the individual claiming a right to make a citizen’s arrest is “uncertain and did not have immediate knowledge” that the victim had been the perpetrator of the alleged crime which would dismiss the McMichaels right to make a citizen’s arrest.1 point -

The black crime rate is high for many reasons. Still have nothing to do with this incident. I can be upset about blacks killing blacks. I can also be upset with flat out racism that plague the black communities . I don’t have to choose one. A white man can be upset about immigration laws and the crimes in his communities. My cell is 409-719-7042. Give me a call when you’re concerned about deliverables or budget. If it’s a real concern, I’ll at least tell you what I know in lieu of speculation. So far, no issues with stadium portion of bond. Just can’t fit the design and construction of press box, bathrooms, seating, etc. in before Fall 2020 season. No need to rush it OR hold out on turf installation. So many programs get to benefit by moving forward with the turf - our huge 300+ band, twirlers, flags, cheer, and westernaires won’t have to stay in the stands just because it’s a mud pit on the field. These groups put hours and hours in. Thankful they’ll get to showcase their talents too.1 point -

I don't give cops any leeway. The Constitution always trumps their feelings. In any official interaction between law enforcement and a citizen, the cop has a gun to your head, whether the gun is drawn or not. They don't get to abuse my rights simply because they get nervous or angry. We, as citizens, trade a little bit of our freedom to law enforcement in the name of safety and protection. In exchange, law enforcement is permitted to use force to secure its objectives, including and especially deadly force. I can't use deadly force against cops, and it would be extremely hard to prove to a jury that a person was using deadly force against a cop in self-defense. So cops have all the power in relation to the person they are stopping. In a routine traffic stop, you might find yourself billy clubbed , or killed, over a cop's misunderstanding. There are plenty of video-recorded examples of citizens being gunned down for absolutely no reason, simply because the cop got scared. I don't care if they get scared, at least as far as my attitude toward them not murdering people goes. So I don't give them any leeway at all, and none of us should. They are to be held to a far higher standard than the rest of us, because their failure to rise to that standard is often deadly. If that is too stressful or too difficult, or too Constitutionally limited, they need to choose a different career. That being said, I am a strong supporter of law enforcement in general, and fully respect many of those who choose to pursue it -- It is an honorable profession. However, I reject any tendency to treat them as if they are above the law because their job is hard. A lot of jobs are hard, but that doesn't mean they get to be trigger-happy over it.1 point
