  11. Freedom of speech is in the Constitution. Now, is it absolute? Of course not. Unless it's obvious, the burden of proof concerning whether or not free speech has been violated falls on the plaintiff. Yelling fire in a crowed theater is obvious not free speech. So, how is it separated? To not fall in the category of free speech, there has to be proven ill intent and malice. Yelling fire easily falls into this category. But, when it's not obvious, how do you know what's in the head of the accused? Like Trump and him being indicted for saying the 2020 election was rigged. The malice part would be Trump believed 100% that the election was not rigged and went and tried to forcefully stop the transfer of power. But there's no doubt he feels it was 100% rigged so there's no malice in what he's done. And talking about alternate electors is all legal. I believe Hillary did the same thing. Oh, and BTW -- didn't AlGore challenge the 2000 election? It got so stupid with the hanging chads and pregnant chads that the Supreme Court had to eventually step in and stop it. But, yes, he had to the to challenge if he wanted to. It just went to far.

  13. You bring up a good point. I think there are two different ways of looking at this. As been discussed, the two are age and competence. What if a 100 year old individual has all of their mental faculties and is spry as a 50 year old do we automatically exclude them from serving? But, age and competence isn't always consistent. Fedderman for example. Has the "right" age, but... I always fall back on letting the people vote for who they want. But, you are right, a lot of times Congress' ratings are low but people like their Congressman. I also think it falls on the individuals and their family and advisors to say, OK, it's time to retire. But, it hasn't always been the case. Their egos and the power they hold doesn't allow them to do the right thing. Example: "Fienstein in California: Why is she holding on?!

What you have here in these cases are two different things. One is the freedom of speech. And, with the Georgia case, the criminalization of the practice of law. Nothing in any of these cases have been illegal. In Georgia, they indicted Trump and all of his lawyers. It's not going anywhere. They just needed a photo op which is backfiring on them. Now I hear that the judge for the Washington, DC case has set the trial date for March 4, 2024. Guess what date Super Tuesday is???? March 5, 2024.
