The 10th Amendment takes care of a lot of this. I know it's been perverted but it's still the Constitution. Hence the wording: "powers not delegated to the United States by the Constitution...are reserved to the States respectively! Again, any "restrictions" not outlined by the Constitution, have been made by politicians and judges.
