And fortunately by Texas law, it doesn’t matter. Texas has no premeditation in homicide laws or as a lawyer once told me, premeditation in Texas is one second.
But yeah, if seeking the death penalty or a harsher punishment if just Murder, this might really sway a jury. Putting on a mask while committing a misdemeanor seems like a stretch.
This should be a death penalty case but who knows how the DA will approach it. They might keep it as a Murder and allow them a chance of parole.
