  1. Yeah, but..... They rules that the Eighth Amendment applies but then ruled that the $63 parking fine was not excessive. So the guy won but he lost. They did rule that the additional approximate $120 for late fees was excessive but didn’t say how much. Perhaps $100 total fine and late fees would be acceptable instead of $181 So the ruling was... the city has to go by the 8A!!! ... but they did on the fine. I guess if they try to charge $200 for a parking meter violation, the federal court may overturn it.
  2. Yeah, I think you grasped the folly that I did. Why think it is so dangerous that you need to carry a rifle but bring a girl that probably can’t even move herself around. Got to feel horrible for her

I don’t know if the shooting was justified or not but looking at a comment in another forum..… A person was defending the now deceased by saying he needed to protect his quadruple amputee fiancé. That was why he was carrying a rifle. My question is, if you are so worried about the safety of a quadruple amputee, why would you bring her to a protest where you had to carry a rifle in order to feel safe? If I am the caretaker of a person who is absolutely restricted to a wheelchair and almost cannot take care of herself, why would I bring her to such an event that in my opinion was so dangerous that I had to carry an AK 47 for protection? Then look at the statements Foster made on camera. He was looking for trouble pretty much in his own words. That does not mean he was wrong, that does not mean that he should have died and hopefully the investigation will find some good answers. I believe that Foster is at least partly to blame for his own death.
  4. You don’t need to be a lawyer to read the law. Mostly you just have to watch for “and” and “or”. When I teach that at LIT I call those the two biggest words in a law. You have to watch out because some of it is state law but much of it is federal law. For example this law says you have to fly more than 400 feet above the ground to comply with state law however a federal law prohibits flight over 400 feet. Also federal law prohibits flight above people. Basically you could almost not fly over a stadium without flying over people. As it says in that law, if you were doing it with consent of the people running to Stadium then it is OK. Mostly if you were a commercial pilot and you’re contracted by the management, you can fly over a sporting event..... as Long as you don’t fly over a person other than a person affiliated with the drone operation. You can get waivers from the FAA for much of what would otherwise be violations such as flying at night. You have to apply for the waiver that goes through Washington DC l. It’s not really a form. You have to explain how you’ll mitigate the danger to the public for each potential action that could happen. I have applied for and gotten two waivers from the FAA for the police department. I can fly drones for them at night and I can fly them in some limited airspace near the Jack Brooks airport. There are other things that may be coming soon such as a device similar to a transponder on an airplane that identifies the drone when in flight. It is also being suggested of lifting some of the night flight prohibitions as long as certain conditions are met and flight over people as long as they have a safety device such as a parachute that deploys if the drone is disabled.

  6. Many (if not most) fire departments stage when they get medical calls and will not go in until the police make sure it is safe. Perhaps the police should return the favor to the second responders.
  7. Yes but when most people say pedophile they are talking child molesting. Even touching a consenting 16 year old through the clothes carries the same penalty. Most people would not consider groping your girlfriend outside of the clothes as a pedophile yet it can land a person in jail for a long time and a life time as a sex offender. That was just as an example. What most people think of is having sexual contact with a small child (even without person to person sex) and that is equal to the murder of an adult. You can spin it any way you wish.
  8. An attorney will know no more than reading the law. They have no magical insight. The public has the same restrictions (even More really) and can have criminal and civil cases against them. Any unauthorized photograph on a drone will allow the victim to sue for up to $5,000 per photo. You can go to Texas Government Code Chapter 423. It is an entire chapter on drone use and restrictions.

Realizing that we all have our own opinions on what should be a crime and how much penalty it should carry, often when I see the term “ridiculous laws” I feel like that in most occasion the person really does not know what he/she is talking about. It is typically something that they “heard”....
  10. OK but on the previous page you mentioned if someone wants to use a drone and would they need a warrant. Warrants are only issued to law-enforcement. I’ve never seen people use the term someone for law-enforcement but if that’s what you meant OK. if the police are conducting surveillance of your property with a drone then they do need a warrant just as they would with any other camera unless it is visible to the public.THEY do you need a warrant. I am not sure what reform you need when the current law already requires a warrant to do what you are claiming.

Like, the prisons are full of people smoking marijuana when in fact no one is in prison for that So let’s go with pedophile which really isn’t a crime but a person sexually attracted to underage prepubescent children. In Texas the age of consent to have sex is 17. We are criminally considered adults at 17. Even though it is legal to have sex with a 17-year-old, if you possess a nude picture of that same adult, it is up to 10 years in prison. That is for a single photograph of an adult. Let’s say you are attracted to a 16-year-old girl who actually looks like an adult and is extremely well built. That is not exactly pedophilia because even though the person is legally under age, she does not look like a child. So a 20 year old, even with consent, rubs on the girl through the clothes with no actual skin to skin contact.. it.carries up to 20 years. Just exposer to a child (even a 16 year old) with no contact is up to 10 years Sex with consent of a child under 17 (and not more than 3 years older) is up to 20. So boyfriend/girlfriend... it doesn’t matter If under 14 it is up to 99 years and it doesn’t matter any age difference So for a true pedophile., merely touching through the clothes is up to 20 years in prison and any kind of sex including just penetration with a finger for example, carries up to 99 years in prison which is equal to murder in Texas. But it will still often be repeated... but you can get more time for......
  12. Private citizens can’t get warrants. Shooting drones is a federal felony and probably several state crimes. You can commit any crime that you wish. If it is worth the consequences or you get away with it, great. I am not criticizing your opinion. I usually try to unemotionally talk about the law as I believe it to be.
  13. All drones over 8.8oz, it has to be registered whether for a hobby or commercially. If it is bigger than the palm of your hand, it is likely regulated by the FAA I have no clue what kind of warrant or the purpose of a warrant you are asking about.
  14. On an interesting note (I think), someone better not get caught shooting down a drone. Drones are federally regulated aircraft including the airspace they fly in. Shooting one down carries a maximum penalty of 20 years in prison and up to a $250,000 fine.
  15. I have flown several law enforcement missions. We have used them for search and rescue, locating a stolen vehicle in a marsh after a tip, close up photographing of radio towers for repair and inspection of police and fire department radios, major crime scenes, real and training missions by SWAT and K9 units, making 3d images of building, and so on. We keep logs of every flight including training flights.
  16. Texas has the most restrictive drone laws in the country. That includes specifics restrictions on law enforcement. There are also federal FAA regulations. You have to be a FAA licensed commercial drone pilot (called sUAV for small unmanned aerial vehicle) to fly for anything other than a hobby, it restricts how high you can fly, no night flights without an FAA waiver, no flying over people, all commercial drones have to be individually registered with its own numbers displayed just like a manned aircraft, etc. Then there are court rulings on unlawful searches.

  21. The Cherokee Nation has nothing to withdraw except an opinion. About 41 years ago a Cherokee chief said that he supported what PNG was doing and now another comes along as says that he doesn’t. PNG did not request nor need the CN’s consent to name their team the Indians in the 1920s. They are the PNG Indians, not the PNG Cherokees Whether they remain the Indians is up to them. The CN has the right to voice their opinion and have done so.
