No. We don’t offer sacrifices. Assuming that his lawyers can show that there is no crime proven beyond a reasonable doubt, he should walk and will. I don’t think that will happen (I think there will be enough to show that the officer at least contributed) but it is how it should be.

I watched him tell obvious lies on national television. His conclusion was, it can’t be determined. Well... yes it can and was. Baden said that from the angle of the bullets it could have happened 3 direct ways. That is true.... if you ignore the rest of the scene. To not tell the entire story in order to stir up controversy is a lie. Baden lied.

Baden will say what you want him to say. I saw him on FNC say that he couldn’t tell if Michael Brown has his hands up. He could tell because the crime scene diagrams and photos should what happened. Baden ignored what didn’t fit his case. Be cherry picks what he needs to make bus case.

Going by Texas law, there are specifically stated uses of deadly force for protection of property only. A person “may” be able to use df for property however the statements that looters can be shot because they are committing theft is not correct. officer: why did You shoot him? shooter: he was stealing. OOPS!!

I read all 20 something witness statements from that case and I think one person backed up Whitehead’s side of events. The others either agreed with Arnold or didn’t agree with him but gave information that backed his version. Like, the officer was wrong and he.. then went on to describe the incident which backed the officer. Those statements were like, I disagree with the officer, because he is a cop or shot my friend... but this is what I saw. I have taken two statements against officers in my career where the witnesses literally said, the officer was wrong, then went on to state facts that made the officer correct.

It depends on where you work and what reporting requirements they have. Is it a “complaint” or just a use of force. Our current use of force (called response to resistance) is documented any time we use any force other than just the suspect submitting to being handcuffed. If that was in place when I first started (36+ years ago), I would have had a use of force almost every week and sometimes more than one a night. Or are try taking about an actual complaint like a person or officer actually filed an excessive force complaint. I have been involved in more than one shooting incident and been to the hospital multiple times in the line of duty and think I have had one complaint that I used to much force. Strangely, in that case I used no force but made what I thought was a reasonable threat. His complaint was roughly, the officer told me that if I tried to hurt him (me), he was going to hurt me worse. Yes, that was the actual complaint... kind of cleaned up for language. So in this case, that is a lot of outside complaints if it is for improper force. It doesn’t mean that he didn’t use lawful force but it would beat looking into.

Yanez shot a man who was reaching for a gun and still got indicted for murder. Noor shot ac woman who called 911. As she was walking up to the police car without any provocation she was shot and killed. You are comparing apples to something other than a fruit.

That is something that I questioned. At the very least, sit him upright. I have been involved in thousands of arrests including some very violent incidents. I agree with you, go straight to a car. On occasion we leave them outside but never restraining them to the ground. If they continue to be violent, off to the car they go.

A contract can guarantee almost anything however I worked for several years without a contract. Police have been placed on administrative leave for decades before contracts even existed , first because they were not convicted of anything or In some cases even accused and also for public safety and/or perception. In other words, for safety we are not going to take any chances and put the officer on the desk. Many Police Departments do not have contracts and some states might deny them. In Texas only the police and firefighters can have contracts. In some states any public workers can have a contract however Texas is not like that. What happens in New York might have absolutely nothing to do with what happens in Texas. For the most part, contracts guarantee s fair heating and do not dictate rules and regulations. Most agencies have an appeals process but the appeal is back to the people that disciplined the officer in the first place. Ours is to an outside/out of state arbitrator by contract.

No. The union is a private entity and not government funded. In fact this kind of incident is exactly what the union lawyer (or any lawyers) are for.

Here is my pondering about the incident. A man is killed and within 24 hours of it happening, Before any investigations is anywhere near complete, the chief apparently has fired officers that were even standing there. They might have had no involvement in the death but they didn’t step in. The president called for a stepped up FBI investigation and the one officer will likely be indicted for murder. Exactly what do the rioters want? This has been the quickest action that I ever recall for any officer involved death and it was sweeping with every officer being terminated immediately. What would the protesters think should have been a better response?

A medical examiner homicide does not equate to a criminal homicide. It might be but it isn’t automatic. The causes of death are accident, natural causes, homicide, suicide and unknown.

No matter the signs, does the owner want to come charges? Well he sign a non-consent statement to prosecute and show up in court? If the cops at the alternator shop wanted to make an arrest, they could have contracted the owner and asked if he wanted to prosecute. A sign isn’t the law, it is a step in the law. Why wouldn’t I answer? i think that if two cops jumped out, they would not have drawn their weapons. I have been involved in thousands of arrests including fighters, three of which sent me to the hospital. The last one I had to have my eyebrow glued back together with two deep lacerations from being hit in the face with a pipe. I never drew my handgun. If an officer did draw his weapon on a misdemeanor arrest without further and ended up shooting the suspect, I believe they might end up in prison like Michael Slager.

Sure. IF you come back, we will file charges. Here is what I think is a pertinent question.... did this homeowner tell McMichael that he wanted the guy arrested. If not, no lawful arrest in my opinion. If the homeowner said, hey go tell that guy not to come in my property....oops! I kind of suspect that may have taken place from my experience. Nothing taken or damaged and the owner sure doesn’t want to get tied up in court. I might even be the owner has already given a statement to the police to that effect. You keep digging these guys deeper and deeper.......

I read an article not long ago on retiring as an officer and it importantly noted, once you retire, walk away. You are no longer an officer so don’t chase scanners calls, try to make arrests, etc. when you walk away... walk away!

I have thought that he may have been acting as an officer when he wasn’t. Hey, I was once a cop isn’t a strong legal defense.

I brought that up in another forum almost from the start. I believe they made sworn statements to the police to that effect or at least the way it was portrayed in the media. IF SO, they might have cut their own throats. The retired cop isn’t a anymore.

And..... Even if such a sign existed, that is not evidence of trespassing. A no trespassing sign doesn’t give even the police the authority to arrest. Maybe your cousin is on your property with permission. That doesn’t give police probable cause that s crime has been committed and arrest him. It means that an officer can detain to investigate (under Terry v. Ohio). Citizens generally don’t have the authority to detain and investigate. To try and do do in Texas might be Unlawful Restraint and up to a year in jail with no weapon displayed. Display a deadly weapon and again, we go into possibly Aggravated Assault.
