Correct call?

Watching the Heat and Pacers in game two....Wade pump fakes and jumps into defender and draws the foul(several times)....what keeps this from being a charge?

well this call was made against me this weekend 3 times and it was explained to me as... " if i would have never jumped it wouldnt have been a foul, but the second i left my feet, since i was in illegal guarding position, any contact warranted a foul on my part"

I hope it wasn't the ref that explained it to you like that.  If so, they need to find a rule book and actually read it.
