These kids had broken into the house and were running out of the house when they got "capped" in the back. Now the kid's families want to sue?

I don't blame the lady but if the law they are reporting is correct........." California law states that a homeowner is permitted to use deadly force when someone enters their home if they have a reasonable fear of death or bodily injury".

 

I think a good lawyer could convinceve a jury that shooting the boys on the way out, they were not in fear of death or bodily injury"........

Not if they thought the boys were running outside to get some extra weapons and come back in again.

IN the last few weeks, there was a lady in Nome who was robbed and pistol whipped in her home. She lost a considerable amount of money and is still recovering from some very serious injuries and dealing with the loss of a lot of blood. She keeps a gun by her bedstand. If another intruder shows up and turns his back to her when she gets ready to fire, should she be sued?

Oh I see your points and I wouldn't convict the lady......probably why I would not get picked for a juror......

 

I'm a firm believer in everything comes down to your actions......

 

Just hate seeing kids get killed for stupid things....even if the deserve it

I have little sympathy for the kids. Personally,
If I had someone come into my house, I would shoot them, but if a situation came up where they were leaving, I would NOT shoot them in the back. But who am I to tell someone who had been tormented by burglars what state of mind they should be in at that point. The fact remains if these criminals had not broken into her house they would not have been shot, and had she not shot them, they would've done the same thing to someone else (likely many more someone elses).
