It appears then, that the case hinged on the definition of "recess".

Yes it did...I thought that was a given. And when you have conservatives and liberals voting unanimously the same way, you can deduce that your position wasn't even close to the same interpretation...which is remarkable considering that the wrong side came from a supposedly constitutional scholar.

So what do you conclude from this...Obama knew he was wrong but tried to slide it through anyway, or was his interpretation shot down 9-0 by fellow constitutional scholars?

So he's either corrupt or ignorant...neither are desirable for the President.

From Ned in a reply to this article:  "The Senate was in "pro-forma" session when President Obama made the appointments. The Constitution empowers the Congress to make its own rules, including when it is in session. Historically other Presidents, including GWB, respected the Senate's "pro forma" sessions as valid and didn't try to make appointments during those times.

How often other Presidents made recess appointments, or how often appointments were filibustered or blocked in some manner, wasn't part of how all nine Justices looked at this case."

NEW, this article is a prime example of appealing to the "Low Information Voter."  This silly article does not say anything about the actual Supreme Court decision.  It's trying to fool it's readers.  The decision -- 9-0 -- had NOTHING to do with the right of the President to recess appointments.   I hope you do realize that!

Funny how nobody had a problem with recess appointments, until now. How many did Bush use without a complaint?

Westend: Ppl will complain when its not their guy. That's how it works on here. (you can use about 80% of the threads on here as evidence of that)  ;)

It is a matter of following the rules or believing that you are not required to comply with the same laws. He could have simply waited until they were truly out of session but like he has done and continues to do, he makes up his own rules as he goes. He got caught this time and when the SCOTUS comes down with a 9-0 ruling, that is a pretty good affirmation that the other side is wrong.

what you are saying is asinine. He knew he needed approval from the Supreme Court. Every executive order is reviewed. You guys were complaining about the ones that were approved by the courts

Buddy, don't tell us you think this 9-0 decision had to do with whether or not making recess appointments is legal or not.

But, other other hand, yes, we claim when a President breaks the law.  You should too!!
