If the plaintiffs continue with their appeal, look for a possibility of the SCOTUS to take up this issue. 

 

The 9th Circuit has in most recent years been the most overturned circuit in the US but I think the 6th Circuit might have overtaken them. This case looks ripe for overturning, if the high court takes it up.
