BTW, did you see what the store owner said? The police confiscated all cell phone video and took the store's surveillance video and now, it's mysteriously missing. Luckily, the store owner was able to sneakily keep his cell phone video, showing the incident from a different angle. Again, how convenient was it that the officer's body cam didn't catch anything? Had the store owner's cell video been confiscated, we would only have what they want us to see... And conspiracy theories are another topic another day that I won't be discussing... I've been detained wrongfully and harrassed by policemen. I complied and remained silent, that's until ibwas called a 'dumb drug dealer' while handcuffed. I then mouthed off to the officer's, but did so in a non threatening manor. I guess that puts me on a high horse for wanting to see what we can prove and you I suppose, needing to choose your words better since it appears what you wrote was not what you meant. All you need to read was seems like to see that I wasn't saying I knew what happened, which means may not be the case. Other than than that I have nothing to say to you. Sit back, I dont think I need to type up 6 or so paragraphs to tell you whats going on out here, video footage is a killer now, welp maybe not killer, overall this still is "Merica". Brotherhoods exists, no different than the olden days. No sense in arguing over a message board about it, well this one in particular where a majority cant seem to grasp different perspectives, been apart of a couple of em underlined, so I see both sides, then there's that common sense thing that alot of people in this area and across the nation is heavily lacking. All I'll say lastly since im done with this side of the forum as of today political included (and no I wont be answering anything pertaining to this message): keep it up, keep mixing up your God given common sense with taught personal views that may be wrong and this here out in our nation right now will be continuing on down the line. I have said I didn't think the shooting is justified. But is there was no resistance in the beginning, it prolly does not end up in a shooting. As is the case in most of these situations. You seem hung up on the tasers for some reason. You can take them out of the equation. They didn't work, either because they malfunctioned, they didn't get proper penetration, or he was on a substance such as PCP that made him impervious to their effects. You can hear them deployed in the video, and it's from point blank range, and he doesn't even flinch. Had they worked, there would've likely been a different outcome, as he would've fallen down immobilized, which would've possibly given the officers a chance to cuff him without a struggle (especially considering they could've reactivated the tasers if he started struggling) Quote Link to comment Share on other sites More sharing options...

Whether the store owner can get it back depends on the criminal procedure laws of that state. Evidence seized at a crime scene does not require a warrant in many or even most situations. Had the police seized something like a cell phone to preserve the evidence from being destroyed, they would need a warrant to view the contents but not to grab the phone. Merely seizing things to be searched usually requires no warrant. Just as an example, if the police have probable cause of a felony happening inside of a home and the evidence may be destroyed, they can seize the home by removing the people from inside and keeping people from entering until a warrant can be obtained or refused. That means that with the proper information, the police can keep you out of your own home without a warrant in order to obtain a warrant and keep evidence from being destroyed. There is also the issue of "standing" to complain but that may be for another day. The lawsuit alleges police stole surveillance video from his shop, confiscated his cell phone, and locked him inside a car for the next four hours. When Abdullah Muhlafi told them he needed to use the bathroom, they wouldn't let him in his own store - instead, he was escorted to the side of his building and forced to relieve himself right there in full view of the public. Muhlafi saw police confront and kill Sterling, who was selling CDs with his permission, last Tuesday night. Muhlafi recorded part of the incident in footage that has since gone viral. The video seems to show that Sterling did not have a weapon in his hand when Officer Howie Lake shouted “gun!” and Officer Blane Salamoni fired six shots into his chest. Muhlafi is suing the officers, police chief Carl Dabadi as well as the Baton Rouge Police Dept. They should have taken the store owner to the police department for a statement. You don't want this guy listening to the media, possibly impacting his perception. In fact, a Material Witness may be arrested if they refuse to cooperate with a court order/subpoena . Futhermore, persons may be excluded from a crime scene (including a business or their own home) while a warrant is being obtained. A warrant was issued around 5am All of this is black law.
