.....had the power to call for a blockade of Cuba during the Missile Crisis of the 60s. This could have been construed as an act of war, and is possibly what Kennedy was hoping at the time, but that's another story.

Since South Korea is operating under UN guidelines enforcing the sanctions against North Korea, is this not considered an act of war?

The US should blockade any oil shipments to N. Korea!  Hopefully it's on the table!
