I believe they have already lost this fight. Unless the Supreme Court makes a radical shift in previous rulings, this case is over. As soon as someone files an njunction, and I expect Texas to within a few hours, the case will end.

Biden needs a different approach. He can’t keep saying things like “get out of the way”. That speaks volumes for the power he thinks he possesses. Could be considered an “abuse” of power.
