Its hard to wrap ones mind about the national and now international gabby obsession, and at this point, I would even say the global collective sickness surrounding gabby. Its gone flat out Mental.    

Millions of people watch 48 Hours and other such investigative and particularly homicide shows. They are very popular.

This is no different than the other shows except it’s playing out in front of their eyes. People are simply interested. Where did the crazy boyfriend go? Is the family helping to cover it up? Are they going to find him dead having committed suicide like about 90% of the people think is going to happen? Is he going to be cornered by the police and have a standoff and a shoot out?

The border is not intriguing. Everybody knows what’s happening. There is no mystery like there is in the Gabby case.

I have a diverse group of coworkers, they are glued to their phones and computer screens 24/7, all but ignoring their work, sitting there in a trance like state, obsessed with gabby 24/7. Work and duty is suffering. This is far beyond any simple "interest". This is a sickness. The UN needs to get involved, PRONTO!!!

I agree, but not if this attorney aided his disappearance or tried to cover it in any way. If this guy is not guilty, a good attorney would have suggested he talk with police to help find Gabby.

People are making lots of assumptions about this case. I don't think an attorney would try and cover up a murder for some stranger off the street so they could be charged with a crime....

A means to legally get him in handcuffs? Even the article says, “while this warrant allows law enforcement to arrest….”. I think this is to change him from a missing person to a wanted felon.

Remember that Timothy McVeigh who blew up the federal building in Oklahoma City was arrested for a license plate violation. 

Like always, every state and federal laws are different. It does not say who’s credit card he used so it could be a legitimate theft. It can also belong to Gabby and in Texas it would be almost a meaningless charge. It is not against the law to use someone else’s debit or credit card. It is against the law to use it without consent. This guy was engaged to Gabby. They probably swapped credit cards several times. There is almost no way they could prove without her statement that he did not have consent to use it. They would have to almost prove murder first and if they prove that, why worry about a credit card charge?

Again, it is probably a felony charge meaning that if he is arrested anywhere, he can be extradited across state lines. It is a police tactic and a means to an end, in my opinion.

I had that same feeling of a pretty stupid Charge, but I also thought it might tell us they have nothing else. It almost looks like all the evidence they went through has not produced any evidence that he killed her.

It is called a pretext stop or fishing expedition. The police can make a lawful detention or arrest but are not really looking for the reason of the detention or arrest.

A police officer stops you at 2 AM with your license plate light out. Are you intoxicated? Do you have warrants? Does something in your car make it appear that you were committing a crime? Or perhaps the officer is really concerned about your license plate light out and the safety hazard you are creating…..

Of course we will never know but there might be enough information for an arrest warrant for murder right now. Remember a warrant just needs probable cause (which is defined as, would a reasonable person believe, knowing what the officer knows)  and nowhere near proof beyond a reasonable doubt. Even if they have enough information to technically get a valid warrant for murder, do you want to tip your hand or rush to do something that may be called into question later (was the probable cause for murder valid?) when you now have a legal felony on him?

I would not read too much into a credit card warrant instead of a murder warrant at this point. It may be absolutely true that they don’t have enough for murder… but maybe…..

This YouTube channel from  Nate the Lawyer says almost exactly what I said. They were engaged. To have enough to prove he didn’t have consent by her death, you would have to prove that he knew she was dead.

He goes a little farther and findssome stupid clerical errors by the FBI. Basically  they indicted him on one charge but put different charge on the warrant. It would be like me doing a probable cause affidavit that you shoplifted something at Walmart (Theft) but then wrote assault on the warrant.  There are two crimes listed in the section on credit cards under federal law. One is to use the card or the number without consent. The other is that you use fraud or forgery to fake the card like maybe he tried to transfer it in his name. They indicted him on the one but wrote the warrant on the other.

Will that clerical error invalidate the warrant? If they arrest him on a warrant that is later found to be insufficient or wrong, that would throw out any confession or any evidence they gathered after making the arrest. That seems pretty sloppy by the FBI. I think they need to get the judge to remove the warrant and simply re-issue it under the correct charge for the indictment but who knows, maybe they will uphold it like it is.
