Certainly.

And fortunately by Texas law, it doesn’t matter. Texas has no premeditation in homicide laws or as a lawyer once told me, premeditation in Texas is one second.

But yeah, if seeking the death penalty or a harsher punishment if just Murder, this might really sway a jury. Putting on a mask while committing a misdemeanor seems like a stretch.

 This should be a death penalty case but who knows how the DA will approach it. They might keep it as a Murder and allow them a chance of parole.

Now they arrested the brother of one of the suspects. Felon in possession of body armor when running a search warrant.

It happens like that.

About 30 years ago we had 2 or 3 people killed by lightning one summer. I don’t remember any in the city before or since yet it happened within the same summer.

We had maybe 8-12 fatal vehicle accidents each year scattered around the city and months. The odds are astronomical of happening on the same highway at the same time yet one day when I was the shift commander we were working two fatal accidents at the same time in the same highway a couple of miles apart where neither had any relation to the other.  It wasn’t like one accident caused a massive traffic jam, which caused a secondary crash. Nope, despite the odds probably like winning the lottery, it happened.

 The craziest which was almost certainly lottery winning odds, when I was in detectives I had a case of a woman being arrested for assaulting her husband. That alone was odd enough because the woman usually does not get arrested. Another detective happen to be walking by my desk and saw the case and said hang on a minute and went to his office. He came back with a case from two years earlier with the exact same woman was arrested for assaulting her husband. The crazy thing was, they were the exact same case numbers. The odds of that happening are probably in the billions but, it happened. 

 This is yet another example.
