That’s called safe harbor or actually the real Election Day.

Safe Harbor had a play in the 2000 presidential election where Gore tried to overturn the election with an unconstitutional recount. The Supreme Court voted 7-2 that the Gore recount was unconstitutional.

 Then they voted 5-4 that there was no time to meet Safe Harbor.
