If no injuries then it is a Class C misdemeanor like a traffic citation. In a Class C charge, a judge cannot issue a jail sentence and can only assess a fine. That’s a bit of a blow up for a shove. About 98% of the time it would not even be reported. In maybe an interesting side note, Class C assaults in Texas have two offenses. One can be by contact with no injuries but the contact would reasonably be believed would be offensive or provocative. Shoving someone, poking them in the chest with a finger, patting a waitress on the butt as she walks by, etc. The other is a threat like I will kick your butt. The display of a deadly weapon, a threat of death and so on are much more serious charges up to years in prison so don’t confuse them. Again, an assault by threat might be something like, I’m about to come over there and give you a fat lip. None of that is really interesting however but since this is a sports forum….. A sports participant is a player, coach, official, etc. If any person “other than” a sports participant commits a Class C assault against a sports participant, it becomes a Class B misdemeanor and up to 180 days in jail. So if an angry parent shoves but doesn’t injure a ref/coach/player or says something like, I’m about to jump this fence and whip your butt, it is up to 180 days in jail and/or up to a $2,000 fine. This doesn’t apply to the sports participants with each other. So if the players shove each other, the coaches and so on, the police aren’t out there to start arresting them. Leave it on the field. That’s what I was referring to when to when I said it was a bit of a blow up for a shove. In the past we wouldn’t normally even take a report for that with no injuries. Our response would be to go to the city court and file their own charges. It would not even be investigated. Quote
