§ 21.12. IMPROPER RELATIONSHIP BETWEEN EDUCATOR AND
STUDENT.  (a) An employee of a public or private primary or
secondary school commits an offense if the employee engages in
sexual contact, sexual intercourse, or deviate sexual intercourse
with a person who is enrolled in a public or private primary or
secondary school at which the employee works and who is not the
employee's spouse.
(b)  An offense under this section is a felony of the second
degree.       
(c)  If conduct constituting an offense under this section
also constitutes an offense under another section of this code, the
actor may be prosecuted under either section or both sections.

Added by Acts 2003, 78th Leg., ch. 224, § 1, eff. Sept. 1,


Age is no longer a factor.

Hopefully DeCello wasn't getting "legal advice" from BLUEDOVE3.

Apparently DeCello didn't know the law either.  However, his "inappropriate behavior" probably wasn't criminal, just an overblown ego of stupidity.

[/quote] Your trying to read too much into what I am saying. It could be a slap on the wrist, nothing criminal and no jail time. Could be a misdemeanor charge. We don't know the facts.

I agree with you.  From what has been reported by the media, nothing criminal occurred.  So his resignation from H-F and being reported to TEA may be his only punishment.
